Observations This Week

During Week 65 of monitoring, conditions observed were consistent with previously documented patterns, including:

• barricades unattended at closure points
• traffic control signage not deployed as required
• vehicles entering the closure area
• no clearly established emergency access lane
• vendor and activation activity extending into sidewalk areas
• commercial vendor activity within the closure area
• sanitation and cleanup issues

Clarification Request (Possessory Interest)
The permit states that the agreement may create a “possessory interest” subject to property taxation when the public right-of-way is used for private purposes. Given the recurring commercial and vendor activity associated with the Hayes Street closure, please clarify whether the permit has been reviewed by the Assessor’s Office for potential possessory interest taxation.

Accordingly, and consistent with our prior submissions, we again call on the SFMTA Board to revoke Permit No. 1316522.
