This marks Week 55 of documented noncompliance on the 400 block of Hayes Street and Week 5 under the renewed permit term (Permit No. 1316522). This weekend conditions on the block again failed to meet permit requirements, including large planter boxes placed directly in the roadway, no delineated emergency access lane, no posted no-parking signage, and no on-site management. On Friday, December 26, the street was open without notice, underscoring informal operation without agency oversight.

After 55 consecutive weeks of documented noncompliance and a demonstrated emergency failure under a renewed permit, this closure reflects a failure of oversight that is unacceptable to both the community and the taxpayer. The record is clear: this closure cannot be operated safely, lawfully, or accountably under the Shared Spaces program. In the absence of any demonstrated corrective action, further continuation is no longer defensible. We again urge SFMTA to revoke Permit No. 1316522 without further delay and restore Hayes Street to its intended, lawful use. In parallel, given the sustained record of harm, risk, and agency inaction, the community is evaluating available administrative and legal remedies necessary to restore lawful street operation and to protect public safety, access, and small businesses. This correspondence should be understood as part of that record.
