Week 52 • Hayes Street Temporary Street Closure Permit No. 1316522 Noncompliance

This marks Week 52 of documented noncompliance on the 400 block of Hayes Street and the second weekend under the newly issued permit (No. 1316522). Despite a new term, and despite programmed activity on both Friday and Saturday, the closure again operated in complete violation of the required permit conditions.

Permit violations for December 5 and 6 include, but are not limited to:

  • Barricades moved out of place
  • Unattended and unmanned barricades
  • No 20-foot emergency access lane
  • No cones or markings to delineate the required emergency lane
  • Planter boxes placed in the roadway
  • Vehicles entering and parked inside the closure
  • Permit not posted
  • Required no-parking/tow-away signs not posted
  • Prohibited general advertising
  • Skateboard, bicycle, scooter, and motorcycle use inside the closure
  • Non-permitted vendor activity
  • Barricade materials not stored in accordance with permit terms

The fact that these conditions persist even on the first two weekends of a newly issued permit makes clear that the operator is either unwilling or unable to meet the minimum requirements of the Shared Spaces program.

At this point, the situation raises an unavoidable question: What will it take for SFMTA to revoke this permit?

If this level of sustained noncompliance is not enough to warrant revocation, then SFMTA owes the public a clear explanation of what conditions would trigger revocation of the permit and termination of the closure.

Absent any correction, and in light of the continued operational failures across two permit terms, we again urge SFMTA to revoke Permit No. 1316522 and restore Hayes Street to its intended, lawful use.
