Here are the block conditions and violations for this past weekend:

This past weekend marked the 27th consecutive week of documented violations under Permit No. 1091787 on the 400 block of Hayes Street. As in prior weeks, the permit holder continued to display unauthorized promotional signage including branded “Hayes Promenade” cones and sawhorses. These materials imply a level of permanence and City endorsement that does not align with the temporary and contested nature of this closure.We recognize that SFMTA is managing a wide range of priorities across the city. That said, the ongoing lack of enforcement in this case is increasingly difficult to reconcile with the agency’s own permitting standards and public space policies.

At this point, the continued noncompliance -combined with the absence of corrective action or public clarification…raises not only operational concerns, but potential legal and reputational risks:

  • Prolonged inaction may be viewed as administrative lapse, particularly in light of the extensive documentation submitted by community members.
  • The use of misleading signage could expose the City to misunderstanding or liability related to misrepresented public programs.
  • The impact on surrounding businesses especially without a clear or inclusive process — has deepened frustration and eroded trust within our community. The continued lack of public clarification has also enabled our Supervisor to go rogue, initiating efforts to make this closure permanent and fold it into a broader Entertainment Zone designation.

We respectfully renew our requests that SFMTA:

  1. Revoke Permit No.1091787 due to persistent and well-documented noncompliance.
  2. Instruct the permit holder to remove all unauthorized signage and branding materials.
  3. Issue a public clarification to confirm that this remains a temporary and contested closure, not a formal or permanent City initiative.

SFMTA’s silence after 27 weeks of consistent violations is untenable. Each week that passes without enforcement compounds the damage and exposes the agency to greater risk. It is time to restore lawful conditions on Hayes Street and restore public trust in the permitting process by bringing this closure to an end.
