URGENT: Escalation Required – Continued Exclusion at Parcel K Bulletin Board

Following up on the inquiry below, sent November 19, regarding control and access to the bulletin board located on City-owned land at Parcel K. We have not received a response to date.

Since that inquiry was sent, circumstances have only underscored the importance of this issue. Hayes Street remains subject to an active closure, and related permitting, enforcement decisions, and ongoing noncompliance continue to generate significant concern among residents and small businesses.

At present, there is no City-sanctioned, accessible way for affected stakeholders to register concerns, post notices, or communicate counter views or needs in a visible, non-disruptive manner at the site itself. A bulletin board labeled as a “community board,” but effectively controlled by a single private organization, does not meet that need. This is not a question of viewpoint. It is a basic question of public access, due process, and whether public-facing communication infrastructure on City-owned land is being administered in a manner consistent with its intended public purpose.

Given the continued closure of Hayes Street and the absence of any City-administered, on-site communication mechanism, the current condition is no longer tenable and requires immediate correction. At this point, the City must take one of two actions: (a) immediately require that the existing bulletin board on Parcel K be made publicly accessible on equal terms, or (b) authorize and support the placement of a clearly designated public bulletin board on or near Parcel K that is openly accessible to all affected stakeholders.

Multiple small businesses along Hayes Street have already expressed interest in participating in and supporting such a public board as a non-disruptive way to share notices, concerns, and information during the closure period. In the absence of an accessible alternative, the current arrangement continues to suppress lawful public expression and exacerbate neighborhood tensions.

We respectfully request confirmation of receipt of this follow-up, identification of the office or individual now responsible for this matter, and a timeline for implementation of one of the remedies described above.
